Piercing Asset Protection Trusts - Creditors’ Rights, Tactics and Strategies

presented by Jay D. Adkisson, JD

Creditors have their own tactics and strategies and rarely will attack an asset protection plan the way the planner hopes. This presentation discusses how creditors view and pursue judgment enforcement cases, including how they variously attempt to circumvent or disarm common asset protection tools.

Jay Adkisson is an attorney who practices in the areas of creditor-debtor litigation, asset protection and wealth preservation, and captive insurance companies and insurance/reinsurance litigation. He is also columnist for Forbes.com. Jay has twice been an expert witness to the U.S. Senate Finance Committee. Jay earned his Juris Doctor degree, with honors, from the University of Oklahoma in 1988, and was a member of the Oklahoma Law Review.  He is the author of The Charging Order Practice Guide (Am.Bar Assoc., 2018); Adkisson's Captive Insurance Companies (IUniv. 2007); and with Chris Riser, Asset Protection: Concepts & Strategies (McGraw-Hill 2004).
